This User Agreement ("Agreement") is made by and between GS Poetry ("GSPoetry.com") and you ("you" or "your"). This Agreement contains the terms and conditions that govern your use of this Web site. Once you become a registered member, you agree and are bound by the terms and conditions of terms stated on this page.
GSPoetry.com and GhettoSoul.com are one in the same entity. As to not violate an exsisting trademark, GhettoSoul had to change its name to GS Poetry. This policy still applies to all members who registered before the name change on March 05, 2007. All members prior to this name change are subject to the terms of this policy.
BY AFFIRMING THAT YOU AGREE WITH THESE TERMS, OR ACCESSING OR USING ANY PART OF THIS WEB SITE, YOU AGREE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THIS AGREEMENT FOR ALL PAST, PRESENT AND FUTURE USES BY YOU OF THE GSPoetry.com WEBSITE. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, DO NOT ACCESS OR USE ANY PART OF THIS WEB SITE. GSPoetry.com RESERVES THE RIGHT TO MAKE CHANGES TO THIS AGREEMENT AT ANY TIME. CONTINUED USE OF ANY PART OF THIS WEB SITE CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES. ACCORDINGLY, YOU SHOULD REVIEW THIS AGREEMENT FROM TIME TO TIME TO BECOME FAMILIAR WITH SUCH CHANGES.
ANY MEMBER OR NON-MEMBER WHO DOES NOT AGREE WITH THESE TERMS AND CONDITIONS CAN REFUSE TO REGISTER OR TERMINATE THEIR MEMBERSHIP.
USE OF OUR WEBSITE OR SERVICES OR THE PURCHASE OF PRODUCTS AFTER POSTED CHANGES MEANS THAT YOU CONSENT TO THE PRIVACY POLICIES AS CHANGED.
ALL TERMS ON THIS PAGE ARE SUBJECT TO CHANGE WITHOUT PRIOR NOTICE.
1.1 - "GSPoetry.com Web site" means the web site located at the domain names "gspoetry.com", "ghettoSoul.com" and at such other domain names used to identify web sites on which GSPoetry.com may offer the GS Poetry services, which includes Ghettosoul.com.
1.2 - "Member" means any person or entity that opens and maintains an account with GSPoetry.com.
1.3 - “User” means any person or entity who visits any page under the GSPoetry.com domain.
1.4 - "site" means a page or network of pages created, hosted and/or maintained on the GSPoetry.com Web site.
2.1 - You will comply with all of the terms and conditions of this Agreement and all applicable laws, regulations and rules when you use GSPoetry.com.
2.2 - GSPoetry.com may modify the GSPoetry.com terms of use at any time with or without notice to you.
2.3 - If GSPoetry.com determines, in its sole and absolute discretion, that you will breach a term or condition of this Agreement by uploading pornographic images or plagiarizing or otherwise does not meet the standards of GSPoetry.com, GSPoetry.com may terminate or disable a membership.
2.4 - You must be at least thirteen (13) years of age to view or post content to this site. Though we do not have an age verification process, any person under the the age of 13 should get their parent's or guardian's permission to become a registered member.
3.1 - To become a Member, you must register with GSPoetry.com through its online registration process. Only Members have the right to view premium content, use the forum and rate poems.
3.2 - You must provide GSPoetry.com with accurate and complete contact information if you become a GSPoetry.com member. If you dp not submit a valid email address, GS Poetry is not responsible if you do not receive site updates or receive support for any site problems (i.e. resovling abuse reports, profile glitches, etc.)
3.3 - You will need to select a password if you become a member. You will be responsible for all use of your password, including, without limitation, any use by any unauthorized third party. You must notify GSPoetry.com immediately if you believe your password has been or may be obtained or used by any unauthorized person or entity.
4.1 - Generally, you must use GSPoetry.com in a manner that demonstrates original work. “Biting” or plagiarism is prohibited. If a member is caught with plagiarized work, their membership will be terminated. If a non-member is caught with plagiarized work, they will no longer be able to post a poem under their nickname. We understand that different nicknames can be used to conceal one’s identity. GSPoetry.com has no control over that. GSPoetry.com will block the IP address of the user or member who submitted the plagiarized work and GSPoetry.com will simply not accept any with plagiarized work. Please publish your own writings.
4.1(a) - The definition of plagarizing is: Three or more words that are taken from another
person's published writing without proper punctuation (quotation marks) being used and/or without mention of
the original author's name.
4.2 - Please read our guidelines regarding the use of the GSPoetry.com forum, G-Soul Café.
4.3 - No one may post any copyrighted material unless the copyright is owned by you or you have consent from the owner of the copyrighted material. Spam, flooding, advertisements, chain letters, pyramid schemes, and solicitations are also inappropriate for GSPoetry.com.
4.4 - No member or user is allowed to use another member's account to post messages, rate poems or browse this community.
4.5 - You understand that all information, data, text, software, music, sound, photographs, graphics, artwork, video, messages or other materials ("content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not GSPoetry.com, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the site. GSPoetry.com does not control the Content posted via the site and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the site, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will GSPoetry.com be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the site.
You agree to not use the site to:
- upload, post, email, transmit or make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
- harm minors in any way;
- impersonate any person or entity, including, but not limited to, a GSPoetry.com official, forum leader, guide, or falsely state or otherwise misrepresent your affiliation with a person or entity;
- forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted;
- upload, post, email, transmit or make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
- upload, post, email, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
- upload, post, email, transmit or make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
- upload, post, email, transmit or make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- disrupt the normal flow of dialogue, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
- interfere with or disrupt the site or servers or networks connected to the site, or disobey any requirements, procedures, policies or regulations of networks connected to the site;
- intentionally or unintentionally violate any applicable local, state, national or international law;
- provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
- "stalk" or otherwise harass another; or
- collect or store personal data about other users.
You acknowledge that GSPoetry.com may or may not pre-screen content, but that GSPoetry.com and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the site. Without limiting the foregoing, GSPoetry.com and its designees shall have the right to remove any Content that violates the TOU or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by GSPoetry.com or submitted to GSPoetry.com, including without limitation information in GSPoetry.com Message Boards, and in all other parts of the site.
You acknowledge, consent and agree that GSPoetry.com may access, preserve, and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOU; (c) respond to claims that any Content violates the rights of third-parties or other claims of abuse; (d) respond to your requests for customer site; or (e) protect the rights, property, or personal safety of GSPoetry.com, its users and the public.
You understand that the technical processing and transmission of the site, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
You understand that the site and software embodied within the site may include security components that permit digital materials to be protected, and use of these materials is subject to usage rules set by GSPoetry.com and/or content providers who provide content to the site. You may not attempt to override or circumvent any of the usage rules embedded into the site. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the site, in whole or in part, is strictly prohibited.
Although GSPoetry.com cannot monitor the conduct of its members off the Web site or on the Web site, it is also a violation of these rules to use any information obtained from the site in order to harass, abuse, or harm another person, or in order to advertise to, solicit, or sell to any member without their prior written consent.
You are solely responsible for your interactions with other GSPoetry.com members. GSPoetry.com reserves the right, but has no obligation, to monitor disputes between you and other members.
4.6 - If any member attempts to use GS Poetry to promote or benefit, financially or non-financially, the member's own website without the permission of the GS Poetry Founder will have their profile disabled or terminated. GS Poetry.com takes NO RESPONSIBILTY for any member that creates their own website and solicits GS Poetry members to join that website without the prior approval of the GS Poetry Founder. GS Poetry will not be held liable for any content, broadcasts, legal violations, libel, defamation or any other actions of that member's personal website.
5.1 - Any image or file uploaded to the GSPoetry.com servers are subject to review and I reserve the right to accept or reject any file uploaded to GSPoetry.com servers.
5.2 - You acknowledge that GSPoetry.com may or may not pre-screen content
GSPoetry.com and the submitter has the right to remove an image or file from its servers at any time for any reason. If the submitter requests removal of any file, they must send an email to gsmember@gspoetry.com
5.3 - Image uploads should be no larger than 200K.
5.4 - Please upload high resolution images. GSPoetry.com will not accept images if they are pixilated (grainy and fuzzy) or blurred.
6.1 - If you submit content to GSPoetry.com (on a message board, in connection with your participation in a GSPoetry.com contest, or otherwise) you hereby grant GSPoetry.com an unrestricted and unlimited license to use such content (or any portion thereof) on the GSPoetry.com Web site, in email "newsletters" or other promotional materials (collectively referred to as "Promotions") to promote or advertise any of your sites or GSPoetry.com, or to allow external entities to republish the material in conjunction with promoting and/or advertising the GSPoetry.com website, or to republish such content on the GSPoetry.com site or affiliates' sites, as the company sees fit, with or without identifying the content as yours on the Promotions, provided that your content is identified as yours on the GS Poetry website within a reasonable period of time subsequent to submission to GSPoetry.com.
6.2 - GSPoetry.com will not use any content submitted or uploaded for monetary gain without the permission of the submitter.
6.3 - Sexually explicit photos/graphics will not be allowed on GS Poetry. If you choose to post sexually explicit photos, YOUR PROFILE WILL BE TERMINATED. If you currently have pictures that are sexually explicit, YOUR PROFILE WILL BE TERMINATED.
(a) Female: Sexually explict photos/graphics include but are not limited to showing breasts without a bra, showing nipples, most of your body being uncovered, showing your butt with or without a thong, most of the butt is uncovered, your vagina, and your pubic hair.
(b) Male: Sexually explict photos/graphics include but are not limited to showing your pubic hair, penis, testicles, most of your body being uncovered, most of the butt is uncovered.
(c) Other: You cannot post photos/graphics of sex acts that include but are not limited to sexual intercourse between any gender or animal and oral sex.
6.4 - No member may post any links that may be in direct competition to GS and it's services. Explicitlly, no member may post links, image links, banners or any other element that may direct another member to other poetry websites.
7.1 - Access
Access to the website features are only available to registered members.
7.2 - Forum, Blog, and Poetry Comments
(a) Please read our forum guidelines.
(b) When posting comments about someone’s poetry or a specific blog topic, understand that not everyone will agree or like what you say. Expect that. Some will be extremely nice and encouraging. Some will be vulgar and demeaning. I believe that’s a part of life and growing up. Yes, it hurts, but that’s life. GSPoetry.com tries hard to keep it reality, instead of just keeping it real.
8.1 - Each party represents and warrants to the other party (i) that it has the full power and authority to enter into and perform under this Agreement, (ii) the execution and performance by it of its obligations under this Agreement do not constitute a breach of or conflict with any other agreement or arrangement by which it is bound, or any applicable laws, regulations or rules, and (iii) this Agreement is a legal, valid and binding obligation of the party executing this Agreement, enforceable in accordance with its terms and conditions.
8.2 - You represent and warrant to GSPoetry.com that any content you submit to GSPoetry.com will not infringe the copyright, trademark, patent, trade secret, rights of privacy and publicity or other legal right of any third party.
8.3 - We do not warrant the accuracy, completeness or usefulness of any information presented in the forum or in the poetry submitted. The comments and poems express the views of the submitter, not necessarily the views of this poetry community.
9.1 - GSPoetry.com PROVIDES ITSELF ON AN "AS IS" BASIS. GSPoetry.com DOES NOT REPRESENT OR WARRANT THAT GSPoetry.com OR ITS USE (i) WILL BE UNINTERRUPTED, (ii) WILL BE FREE OF INACCURACIES OR ERRORS, (iii) WILL MEET YOUR REQUIREMENTS, OR (iv) WILL OPERATE IN THE CONFIGURATION OR WITH THE HARDWARE OR SOFTWARE YOU USE. GSPoetry.com MAKES NO WARRANTIES OTHER THAN THOSE MADE EXPRESSLY IN THIS AGREEMENT, AND HEREBY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY AND NON-INFRINGEMENT.
9.2 - THE THIRD-PARTY LINKS, SERVICES, RESOURCES AND INFORMATION THAT GSPoetry.com PROVIDES ON OR MAKES AVAILABLE THROUGH THE GSPoetry.com WEB SITE ARE NOT CONTROLLED BY GSPoetry.com. ACCORDINGLY, GSPoetry.com MAKES NO WARRANTIES REGARDING SUCH THIRD-PARTY SERVICES, RESOURCES AND INFORMATION, INCLUDING WITHOUT LIMITATION, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY AND NON-INFRINGEMENT AND WILL NOT BE LIABLE FOR YOUR USE OF OR RELIANCE ON SUCH THIRD-PARTY SERVICES, RESOURCES OR INFORMATION.
9.3 - GSPoetry.com WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF, RELATING TO OR CONNECTED WITH THE USE OF THE UPLOADED CONTENT, BASED ON ANY CAUSE OF ACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
GSPoetry.com may use third-parties to provide certain services that you may link to from GSPoetry.com. For example, the GSPoetry.com site uses the PayPal.com website to conduct monetary transactions. These services may have their own terms of use and other policies. You will be governed by such terms and policies as well as the terms of this Agreement.
The following agreements, rules and policies contain additional terms and conditions that govern your use of GSPoetry.com. GSPoetry.com reserves the right to make changes to such agreements, rules and policies at any time. Continued use of any part of GSPoetry.com constitutes your acceptance of such changes. Accordingly, you should review such agreements, rules and policies from time to time to become familiar with such changes. If the terms of any of the following conflict with the terms of this Agreement, the terms of this Agreement will govern and be given precedence.
12.1 - In its sole and absolute discretion, with or without notice to you, GSPoetry.com can (i) suspend or terminate your GSPoetry.com membership, (ii) t remove any of your images or poetry from GSPoetry.com servers and (iii) prohibit you from opening any memberships under the nickname you specified. GS Poetry cannot and will not stop any member from registering for another account under a different nickname.
12.2 - If you are a Member, you may terminate your account for any reason at any time by sending an email to gsmember@gspoetry.com. We reserve the right to permanently store, maintain, use and display all images uploaded by you in the past, even if you terminate your membership. Please note that membership termination will not necessarily result in your information being purged/terminated from GS Poetry databases; just that you will no longer be able to access premium content and features on GS Poetry. We will delete all information for a member at their request.
12.3 - This Agreement will survive indefinitely unless and until GSPoetry.com chooses to terminate it, regardless of whether any account you open is terminated by you or GSPoetry.com.
12.4 - If you or GSPoetry.com terminate your membership, or if GSPoetry.com takes any action pursuant to Section 12.1, GSPoetry.com may delete any poetry, images or files on GSPoetry.com servers or otherwise in its possession and GSPoetry.com will have no liability to you or any third party for doing so.
All notices required or permitted to be given under this Agreement will be sent via email. No other format will be used. You can print the email and save it for your records. If GSPoetry.com provides notice to you, GSPoetry.com must use the contact information provided by you to GSPoetry.com.

The forum is actively moderated and monitored throughout the week. Anyone who feels that a post, comment or poem is objectionable can notify the administrator of GSPoetry.com. We have the rights to remove objectionable content, within a reasonable time frame, if we determine that removal is necessary. This policy also applies to member profiles.
14.1 - The website may provide, or third parties may provide, links to other internet sites or resources. Because GS Poetry has no control over such sites and resources, you acknowledge and agree that GS Poetry is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that GS Poetry shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
14.2 - GS Poetry is not affiliated with any of the links and advertisements provided by Google. We don't support, associate or communicate with any company other than the links located on our links page. Once you leave the GS Poetry website and domain, GS Poetry is not responsible or liable for any transactions, views, or material the user encounters.
To maintain the integrity of the site, members can report abuse by other members to GS administrators. Members can report abuse against other members for the following: harassment, excessive and persistent use of profanity, stalking, or any member conducting themselves in a manner that is detrimental are harmful to community. Prolonged misbehavior and complaints made by members will result in the accusing member's profile to be disabled or terminated.
- If a member gets five (5) reports of abuse against them, their account will get disabled.
- If a member gets three (3) reports of abuse against them from the same member, their account will get disabled.
If it is found that a member is maliciously and falsely reporting abuse against another member, the accusing party will have their account disabled. Abusing this "Report Abuse" policy will not be tolerated. This policy is not limited to what is stated under this policy. GSPoetry has the right to change, remove or add stipulations accordingly without notice.
GS Poetry administrators have full authority to terminate and disable accounts at any time for any reason. If adminstrators feel that a member is purposely abusing the system, their profile will get disabled or terminated.
GS Poetry trademarks and other GS Poetry logos, photos, images and products names are the sole property of GS Poetry. Without the prior permission from GSPoetry.com, you agree not to display or use in any manner, the GS Poetry logos, photos, images. Purchasing the GS Poetry t-shirt grants the purchaser use to wear and display the GS Poetry logo. It does not grant the purchaser, or anyone else, to duplicate and distribute the logo for profit or non-profit.
You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the website or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by MyYearbook or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the site.
GS Poetry respects the intellectual property of others, and we ask our users to do the same. GS Poetry may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who are infringers and particularly repeat infringers. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please read the infromation below and send an email to gsmember@gspoetry.com
How to claim a copyright infringement:
Pursuant to 17 U.S.C. 512(c) (2), all notifications of claimed copyright infringement on the "GS Poetry" website should be sent to our team at gsmember@gspoetry.com and shall include the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf.
- Identification of the copyrighted work(s) claimed to have been infringed.
- Identification of the material claimed to infringe the copyright(s), reasonably sufficient to enable "GS Poetry" to locate the material in order to remove the material or disable access.
- Information reasonably sufficient to allow "GS Poetry" to contact the complaining party (including name, address, phone number, and e-mail
address)
- Statement that the complaining Claimant has a "good faith belief that use of the material in the manner complained of is not authorized by the copyright (holder), its agent or the law."
- Statement that the information in the notice is accurate, and under PENALTY OF PERJURY, that the complaining party is authorized to act on behalf of the copyright owner.
NOTE: UNDER FEDERAL LAW, IF YOU KNOWINGLY MISREPRESENT THAT ONLINE MATERIAL IS INFRINGING, YOU MAY BE SUBJECT TO CIVIL PENALTIES, INCLUDING MONETARY DAMAGES, COURT COSTS, AND ATTORNEYS FEES INCURRED BY GS POETRY, OR BY ANY COPYRIGHT OWNER'S LICENSEE THAT IS INJURED AS A RESULT OR A MISREPRESENTATION. IN ADDITION, YOU MAY ALSO BE SUBJECT TO CRIMINAL CHARGES FOR PERJURY, IN ACCORDANCE WITH APPLICABLE LAW. GS POETRY PROSECUTES TO THE FULL EXTENT ALLOWABLE BY LAW.
